1. Hire Mr. H. as your lawyer – he is excellent in and out of court. Your spouse should hire a lawyer like Mr. H. 2. Unless a party has a personality disorder and their lawyer is a jerk, virtually every case can be resolved without court. 3. Written Discovery almost always wastes time and money; find another way to exchange information. 4. Hire tough but fair property evaluators. 5. Use mediation as often as needed. In property cases, you risk millions in court, whereas meditation gives you more control. 6. Where there's dishonesty and hiding assets, or where there's a narcissist or a jerk lawyer, that's when we go to court.
An example of Mr. H applying his higher standard is a $2 million estate between my client, a young dentist, and his wife. The wife hired a jerky lawyer, so while it was difficult for Mr. Hiller to apply his high standard, he did so wherever possible. For example, his wife was determined to punish him for his alleged affair. It's important to note that virtually all financial experts say using the divorce system to punish your spouse is the worst financial decision. Regardless, it's done way too much. The wife wanted to keep their young children away from my client, so we asked for custody. On the eve of the trial, they agreed to stop punishing him through the children, so we settled the kid's issues. Still, there was the value of the dental practice. We hired a tough but fair valuation expert, but they hired an unreasonable expert. So we went to the jury with our experts, and the jury chose our $140,000 value instead of their outlandish $500,000 value. Our higher standard paid off again. My client got to see his kids with a regular parenting schedule and got to keep his practice without paying his wife of fortune. He also got to move on with his life with someone who brought him happiness. Another Win-Win-Win!
